What is Licensing?
Licensing is a powerful and flexible means for creating partnerships that bring innovation out of the darkness of an inventor’s workshop and into the light of the marketplace.

Simply put, a license is analogous to a “lease” agreement between an owner (licensor) and a lessee (licensee) that is based on granting permission to use property in exchange for compensation.

However, rather than leasing something “tangible” such as a car or a home, licenses apply to intangible assets (i.e., IP), which are creations of the mind, such as formulas, drawings, processes, software, or literary
and artistic works that are protected by patents, trademarks, copyrights, know-how or trade secrets.

Unlike tangible property, IP can be made available (licensed) to multiple users in several places at the same time. However, the lease/license is only good for a limited period of time and under terms and conditions dictated by a mutually agreed licensing agreement.

These agreements also limit how IP can be used to assure that licensees pay only for the benefit of their use and, in turn, licensors receive their “fair share” in return for each use. It is through this compensation
that inventors are able to fund and undertake further research and development (R&D) and the cycle of invention is perpetuated.

Pitching to Potential Licensees to Earn Royalties
If you want to license your invention that’s an industry-specific product, like a housewares or hardware company, look for the leading brands selling online and in retail brick and mortar stores where you could envision your invention together with their products. Go on that company’s website, find the number and call their office, and find out what their process is to pitch or submit your invention. Also, take a look and notice if they list the retailers that they’re in, so you can calculate if they can do some good volume if your invention was included in their product line. And while you’re looking through their products, make sure your invention idea would fit in with theirs. If and when you get someone on the phone or get their email address, be prepared to share video links, pictures, and benefits of why your product is for them.

There are licensing agents within industries that can walk your idea directly to these licensees and earn a small percentage of your royalty negotiated. Or you may want to attend upcoming industry trade shows where most of these industry manufacturers, these potential licensees, showcase their new products to their buyers. You can go onto a trade show listing website, like TSNN.com Trade Show News Network that lets you search by industry, area, and region to see what shows are coming up. 

Once you find trade shows that are related to your industry, go directly to their websites and see what credentials you may need, and try to attend, especially if there’s one that’s close to you. Many are inventor-friendly and even have a dedicated area to showcase new inventions. When you’re at the tradeshow, you have the opportunity to see new products from the industry, find potential licensees to pitch or you may even bump into a few buyers along the way – and maybe your invention will be exhibited at the next one!

Question: 

Is a patent valid in every country?

Answer: Patents are territorial rights. In general, the exclusive rights are only applicable in the country or region in which a patent has been filed and granted, in accordance with the law of that country or region.

There are two ways to protect your utility patents internationally: File an application with the utility patents office of each country you wish to target. Submit an international application under the Patent Cooperation Treaty, administered by WIPO (World Intellectual Property Organization) WIPO works to develop a balanced and effective international intellectual property (IP) system, a key part of which is dedicated to patents.

WIPO’s member states collaborate in various areas, including on agreeing the treaties and conventions that underpin the international IP system and that make the global exchange of creativity and innovation possible. The IP services that WIPO offers, such as the facilitation of international patent protection under the PCT System, complement services available at the national and/or regional level. It’s important to remember that WIPO does not actually grant patents per se: the grant or refusal of a patent still rests with the relevant national or regional patent office.

National Inventor Club hosted guest speaker Bridget Weston, CEO of SCORE Association sharing how to connect up with free business mentors volunteering their time and learn of other helpful resources available to build and grow your business and invention ideas, and you can also find out how to become a mentor to others.

SCORE, the nation’s largest network of volunteer, expert business mentors, is dedicated to helping small businesses get off the ground, grow and achieve their goals. Since 1964, we have provided education and mentorship to more than 11 million entrepreneurs. SCORE is a 501(c)(3) nonprofit organization and a resource partner of the U.S. Small Business Administration (SBA). 

Other intro guests included best-selling author Charlene Walters, of Launch Your Inner Entrepreneur, who provided us with great tips and advice for entrepreneurs. We also heard business advice from Erica Chase Gregory, a representative from the Small Business Development Center, Farmingdale NY. We were also joined by Will Salas from PTRC Patent and Trademark Resource Center who gave us tips on how their office can help inventors with our patent search or on how we can search trademarks. Christopher Prone, a representative from the USPTO(US Patent & Trademark Office) Outreach Office offered the club information on how we can take advantage of the services and programs available and Kelly Twichel, a SCORE mentoring success story!

The Got Invention Show

The Got Invention Show features a 30-minute interview where an inventor promotes an invention, seeks a licensing deal, or looks for distribution opportunities. His patented cold weather mask is a lightweight silicone mask covering the mouth and nose, and looks a bit like a N95 mask. There is a huge unmet need for inhalation of warm air in cooler climates and winter. The harmful effects of breathing cold air is well known in the Art. 25 million asthmatics can use this mask along with 100 million Americans who walk, taken together with the military, Athletics, outdoor workers, outdoor sports enthusiasts and more.

Working with a company in China to manufacture. Patented. Prototype made. Second invention is a patented therapeutic heat mask powered by a heat gun, which is an upscale hair dryer, which is computer controlled for airflow and temperature. The proposed temperature mimics the Finnish sauna which has been used for 7000+yrs at temperatures of about 156F to 214F. To millions of people without toxicity.

“I used to think if you had a great idea and made a prototype I would be drowning in money. My first two products were a flop, although number two I plan to adjust some things and retry. My number three product is finally signed officially to be on a TV show channel next year, it went through four years of redesigning prototypes, actually there was nine of them, (the company I licensed with paid for the last seven). 

What I know now is you need to have several product projects going on (I have 4-5 more now) and maybe a couple or a few will work out.
